THE TERMS AND CONDITIONS SET FORTH ON THIS FORM (THE
"TERMS") CONSTITUTES THE ENTIRE AGREEMENT BETWEEN CYBERGIFTCENTER.COM
AND THE BUYER. CYBERGIFTCENTER.COM WILL NOT BE BOUND BY ANY TERMS
ON BUYERS ORDER OR OTHER FORMS THAT ARE INCONSISTENT WITH THESE TERMS.
ACCEPTANCE BY BUYER OF THESE TERMS MAY BE MADE EITHER (1) PLACEMENT
OF AN ORDER THROUGH THE CYBERGIFTCENTER ONLINE ORDERING SYSTEM (2)
PLACEMENT OF AN ORDER THROUGH THE CYBERGIFTCENTER TELEPHONE ORDERING
SYSTEM OR (3) RECEIPT BY BUYER OF DELIVERY OF ANY PRODUCTS ORDERED
THROUGH THE CYBERGIFTCENTER SERVICE. |

PRICING POLICY
CYBERGIFTCENTER.COM reserves the right to adjust prices due to errors
or changing market conditions. Advertisements, Catalogs and on-line
services are prepared in advance and does not account for the fluctuations
of market prices. Therefore, CYBERGIFTCENTER.COM does not guarantee
previous discount structures will apply to this purchase order.
CYBERGIFTCENTER.COM
reserves the right, in its sole discretion and without any obligation,
to make improvements to, or correct any error or omissions in any
portion of the Service or the Materials. |

RETURNS
POLICY
|
|
Prior
to returning any item, you must receive a Return Merchandise
Authorization (RMA) number. No returns, of any type, will be
accepted without an RMA number. Please have the following information
on hand when you call to receive an RMA number: Invoice number,
Reason for return and course of action sought on the merchandise
to be returned. |

|
All
RMA numbers must appear on your return shipping label. RMA numbers
are valid for ten (10) days from issue date. |
|
|
Personalized
items are purchased by the customer under no refund, no exchange
policy. |
|
|
All
damaged merchandise must be returned within fifteen (15) days
of the invoice date. |
|
|
All
shipping and insurance charges on all RMAs must be prepaid
by the customer (NO CODS WILL BE ACCEPTED). |
|
|
All
returns for credit or exchange must be done within thirty (30)
days of the invoice date. |
|
|
All
returns for credit must be in resaleable condition, include
original packing material and all other accessories provided
upon original delivery. |
|
|
All
returns for refund will be at eighty five percent (85%) of the
original purchase price (15% restocking will be charged on all
returns.) |
|
|
Packages
refused at the time of delivery will be considered a return
and is subject to a 15% restocking fee. Shipping & Handling
will be non refundable. |
|
|
Once
Credit Card is charged, cancelled orders will be charged a 5%
order processing fee. |
|
|
Shipping
and handling charges are not refundable under any circumstances. |
|
|
Damaged
merchandise can be replaced at Sellers discretion. |
|
|
There
is no refund or exchange available on items purchased from "Free
Stuff Center" |
|
|
Warranty
on all products is only 30 days from the date the items are
shipped from our location, unless otherwise posted on the invoice.
No product will be exchanged or refunded under any circumstance
after the 30 day warranty is over. If a product is received
broken or physically damaged by the customer, CYBERGIFTCENTER.COM
must be informed about it within 24hours of receiving the package.
After that, no physically damaged processor will be accepted. |

If
a product, received by CYBERGIFTCENTER.COM from the customer
for exchange or refund, is physically damaged, it will not be
covered under any warranty. Product will be shipped back to
the customer in the condition it was received. No exceptions. |

SHIPPING POLICIES
All orders are processed at 4:30pm EST M-F. Orders placed after 4:30pm
EST will be processed the next business day.
Processing time varies depending on the product and services requested.
Processing time is mentioned on individual product pages as well as
on all orders sheets. We ship to all 50 states.
CYBERGIFTCENTER.COM reserves
the right to accept or refuse any international credit card orders.
Shipping will be quoted based on the size and weight of the order
and the location of delivery. Customers are responsible for any custom
charges and/or duties at the port of delivery. CYBERGIFTCENTER.COM
is not responsible for any such charges and will forward such charges
to the customer's credit card if necessary.
In case if the customer receives incorrect, incomplete or physically
damaged shipment, it must be reported to CYBERGIFTCENTER.COM within
24 hours after the package has been received by the customer. All
packaging must be saved so that necessary claims can be filed. No
exceptions.
Customers will be charged an address change fee of $5.00 for UPS and
$10.00 for FedEx if the delivery address is changed once the package
is left from the premises for delivery to the original address. Credit
Card will automatically be charged if such a notice is received by
the Carrier. |

LIMITATION OF LIABILITY
CYBERGIFTCENTER.COM IS A RESEALLER AND DOES NOT MANUFACTURER
ANY OF THE PRODUCTS DISPLAYED ON ITS WEBSITE. ALL PRODUCTS, SERVICE
AND MATERIALS ARE PROVIDED BY CYBERGIFTCENTER ON AN "AS IS"
BASIS, AND CYBERGIFTCENTER EXPRESSLY DISCLAIMS ANY AND ALL WARRANTIES,
EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY
AND FITNESS FOR A PARTICULAR PURPOSE, WITH RESPECT TO THE SERVICE
OR ANY MATERIALS AND PRODUCTS SHOWN ON THE CYBERGIFTCENTER WEBSITE.
IN NO EVENT SHALL CYBERGIFTCENTER.COM BE LIABLE FOR ANY DIRECT, INDIRECT,
INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES OF ANY KIND WHATSOEVER
WITH RESPECT TO THE SERVICE, THE MATERIALS AND THE PRODUCTS.
IN ALL CIRCUMSTANCES CYBERGIFTCENTER.COM'S MAXIMUM LIABILITY IS LIMITED
TO THE PURCHASE PRICE OF THE PRODUCTS SOLD. CYBERGIFTCENTER.COM SHALL
NOT, UNDER ANY CIRCUMSTANCES, BE LIABLE UPON A CLAIM OR ACTION IN
CONTRACT, TORT, INDEMNITY OR CONTRIBUTION, OR OTHER CLAIMS RELATING
TO THE PRODUCTS IT SELLS WHICH EXCEEDS THIS LIABILITY LIMIT. CYBERGIFTCENTER.COM
SHALL NOT BE LIABLE FOR THIRD PARTY CLAIMS FOR DAMAGES AGAINST THE
CUSTOMER, OR DELAYS, INTERRUPTION OF SERVICE, LOSS OF BUSINESS, LOSS
OR DAMAGE TO EXEMPLARY DAMAGES, WHETHER OR NOT CYBERGIFTCENTER.COM
IS APPRISED OF THE POSSIBILITY OF SUCH CLAIMS OR DAMAGES.
EVERY EFFORT HAS BEEN MADE TO ENSURE THE ACCURACY OF ALL INFORMATION
CONTAINED HEREIN. CYBERGIFTCENTER.COM MAKES NO WARRANTY EXPRESSED
OR IMPLIED WITH RESPECT TO ACCURACY OF THE INFORMATION, INCLUDING
PRICE, PRODUCT EDITORIALS OR PRODUCT SPECIFICATIONS. PRODUCT AND MANUFACTURER
NAMES AND LOGOS ARE USED ONLY FOR THE PURPOSE OF IDENTIFICATION.

REPRESENTATIONS
Customer acknowledges that he or she has read the warranty disclaimer
and understands the same and agrees to be bound by its terms and conditions.
Customer acknowledges that except as set forth in this document, neither
CYBERGIFTCENTER.COM nor any other person has made, and customer had
not relied upon, any express or other warranty or representation (including,
without limitation, advertising materials, brochures or other descriptive
literature) concerning any products.
These Terms and performance by the parties hereunder shall be construed
in accordance with the laws of the State of Florida, U.S.A., without
regard to provisions on the conflicts of laws. Buyer and CYBERGIFTCENTER.COM
consent to the exclusive jurisdiction of, and venue in, the state
and federal courts of Dade County, Florida, U.S.A. These Terms constitute
the entire agreement between CYBERGIFTCENTER.COM and Buyer and supersede
all previous communications, representations and agreements, whether
oral or written, between the Buyer and CYBERGIFTCENTER.COM with respect
to the subject matter hereof. |
