End User License Agreement
1. Definitions
1.1 The "Software" means any games appearing on this website, including the executable, and all data distributed with or via the executable, including but not limited to image data, map data, configuration data, sound files, and 3d models.1.2 The "Author" refers to Shizmoo Games, Inc.
1.3 The "User" refers to the party accepting this license agreement in return for the permission to use the Software as described in this agreement.
1.4 The "Servers" refer to the computers used to and programs designed to interact and exchange data with the software.
1.5 The software's website will in the future be located at the url: "http://www.shizmoo.com", but may change.
2. License Grant
2.1 Upon the user's acceptance of this agreement, the author hereby grants the user the limited license to use and store one copy of the software on a single computer. This does not imply ownership or any other privileges not specifically granted in this agreement.3. Indemnification
3.1 The software is provided "AS IS" without warranty of any kind, either expressed or implied, not even the implied warranty of fitness for a particular purpose. The user hereby agrees not to hold the author responsible for any damages or losses resulting from use of the software. Additionally, the author is not responsible for support or maintenance of the software. The user agrees that he will not attempt to access the servers in any way other than using the software in its original form. The user hereby agrees to use the software only with servers administrated or licensed by the author.4.2 The user hereby agrees that under no circumstances will he profit from the software or use it commercially. The user hereby agrees that under no circumstances will he sell his account or sell access to software. The user hereby agrees that under no circumstances will he redistribute the software to a third party. The user hereby agrees that under no circumstances will he sell maps, configuration files, or any other information derived from the software or created using the software.
4.3 The user hereby agrees that under no circumstances will he create or redistribute derivative works of the executable portions of the software for any purpose.
5. Rules of conduct
5.1 The user agrees that he may under no circumstances make defamatory, insulting, or lewd remarks on chat, as an account name, or in any other textual form.5.2 The user agrees that he will not intentionally 'spam', type in all capitals, or create large amounts of text in the chat.
5.3 The user agrees not to cheat or otherwise try to break the rules of the game(s) played using the software. Cheating includes but is not limited to any abuse or manipulation of the rating system, 'fixing' the outcome games, or exploitation of bugs.
5.4 The user agrees to regularly review any and all additional rules of conduct which the author places in the software or on the software's official website. The user agrees to obey these rules of conduct while using the Software.
5.5 The user agrees not to conduct any illegal activities via the Software.
5.6 The user agrees that he will keep his password and personal information confidential, and will not transfer his account to another person nor use any other person's account.
5.7 The user agrees that he will create and use only a single account.
6. Privacy of information
6.1 The author does not provide any guarantee of privacy, neither of conversation, nor information, nor data exchanged via the software. The user hereby grants the author the right to monitor and store his conversations and any other data exchanged via the software. The user hereby grants the author the exclusive right to use, sell, and repackage any and all information and data exchanged via the software.6.2 The user hereby grants the author the exclusive right to use, sell, and repackage any and all data created using the software or any derivative works of the software or derivative works of data obtained through use of the software.
7. Lawfulness
7.1 The user understands and agrees that this License Agreement shall be legally binding in a court of law.7.2 Should any portion of this agreement be deemed unlawful by a court of law, the user agrees that all other portions shall remain in full force and effect.
