Port LaBelle Inn Deeded Back To Seibel



Michael Lafferty Gives Hotel Back To Richard Seibel


LABELLE, FL. -- In order to avoid a court foreclosure against the Port LaBelle Inn, Port LaBelle Resorts, LLC owned by Michael John Lafferty, gave a deed for the hotel property and adjoining land back to Richard and Mary "Dottie" Seibel operating as J & D Of LaBelle, LLP.
The deed filed August 20 in Hendry County was a "Deed In Lieu Of Foreclosure" meaning Lafferty was presumably delinquent in mortgage payments to Siebel, and to avoid a foreclosure fight in court, gave Seibel a deed to avoid the courts.
Lafferty Development, LLC., a new company operated by Michael John Lafferty of Naples and Arizona took over the Port LaBelle Inn December 1, 2005 from Richard and Mary "Dottie" Seibel with hopes to expand the 50-room operation which sits on 5.4 acres along State Road 80 east of the city of LaBelle, and sell off the adjoining land to developers for high density development.
The purchase included acreage zoned agricultural/leisure that was formerly part of the Port LaBelle Oxbow golf course. Surrounding property owners are now attempting to rezone the former golf course to allow high density development including condos, offices, and apartments. The land is listed in the 1999 Hendry Comprehensive Land Plan as a Regional Park, but the county's planning director says since the splitting up of the land among new owners, the county is now out of compliance with the county's land use regulations filed with the state's Department of Community Affairs. A regional park is designated for use by several counties. S.O.A.R, a citizens group trying to keep the recreational use designation, says the buyers purchased the land while it was designated for recreation as a regional park, and want to keep it that way to meet requirements set by Florida's Department of Community Affairs.
Lafferty bought the property under various partnership arrangements including Port LaBelle Resorts, LLC and MJL Main Properties, an Arizona company. Lafferty also created Fl East 31, LLC, another limited liability corporation the same day in November 2005 as Lafferty Development, and formed No Paltalones W Division, LLC with Ft. Myers partner Samir Cabrera in October, 2005. Cabrera is a Ft. Myers real estate agent who has listed the property for sale with no success for the last several years. Cabrera's name has been removed from the for sale signs in the last several days. The oversized signs are located around the former golf course surrounding the hotel.
The December 2005 $4 million hotel and land deal included a $3 million mortgage back to the Seibel's partnership, J and D of LaBelle LPC along with a 34-page security agreement covering collateral pledged, including the hotel's furnishings. The mortgage would have been the subject of a foreclosure suit if Lafferty fell behind in payments. Lafferty has another interest only payment, but balloon mortgage with a payment of over a million dollars due in November on another parcel adjoining the hotel.

Hotel and Restaurant Poorly Run, But Now Cleaned Up
The motel property and restaurant have been the subject of numerous state health and safety citations and violations that were ignored by Lafferty and his managers through many state inspections. Customer complaints ranged from poor maintenance to no night clerk on site after 10 p.m. The restaurant had numerous health and safety violations that were also ignored by restaurant managers, including having no restaurant license, and no certified food manager or staff food handling training.
New motel owner Seibel has been cleaning up the property including mowing the three-foot high weeds that had overgrown the property in recent years, and making sure state hotel safety and health standards are being kept. Siebel is now attempting to rent the motel rooms by the month as well as for nightly stays to up the motel's income stream. Since there was little to attract overnight stays to the Port LaBelle motel --  no golf course, deteriorated tennis courts and unkempt grounds, the previous owner had catered to clientel including motorcycle clubs, tractor-trailer drivers, and construction workers, with pickup trucks the usual vehicle found in the mostly vacant parking lot.

CLEWISTON, FL. -- The Clewiston Police Department and the Florida Department of Law Enforcement announce the arrest of Guadalupe Gonzales, 51, of Clewiston, Fla. for the murdering one man and critically injuring the man's brother. Gonzales is charged with one count of second-degree murder and one count of attempted felony murder.

Wednesday night the Clewiston Police Department responded to a fight at the Everglades Mobile Home Park in Clewiston. When police arrived on the scene, witnesses told them two men had been shot and the victims had been taken to a local hospital by friends. Officers located the first victim, Jorge Rico, 21, deceased at the Hendry Regional Hospital. The second victim, Juan Rico, 22, was flown to Lee Memorial Hospital in Lee County.

According to witness statements, a fight began between two males at the mobile home park around 7:30 p.m. A large group gathered and several other fights occurred. During the altercation Gonzales allegedly retrieved a weapon and shot both brothers.  Gonzales was booked into the Hendry County Jail. The investigation is ongoing.

FDLE provided crime scene and investigative assistance to the Clewiston Police Department.

BELLE GLADE, FL. -- Air Force Airman Archey Forteza has graduated from basic military training at Lackland Air Force Base, San Antonio, Texas. During the six weeks of training, the airman studied the Air Force mission, organization, and military customs and courtesies; performed drill and ceremony marches, and received physical training, rifle marksmanship, field training exercises, and special training in human relations. In addition, airmen who complete basic training earn credits toward an associate degree through the Community College of the Air Force. He is the son of Adelaida Bequer of N.E. 24th St., Belle Glade, Fla. Forteza is a 2005 graduate of Glades Central High School, Belle Glade.

Ashlie K. Turner graduated from the Army ROTC (Reserve Officer Training Corps) Leader Development and Assessment Course, also known as "Operation Warrior Forge," at Fort Lewis, Tacoma, Wash.  The 33 days of training provide the best possible professional training and evaluation for all cadets in the aspects of military life, administration and logistical support.  Although continued military training and leadership development is included in the curriculum, the primary focus of the course is to develop and evaluate each cadet's officer potential as a leader by exercising the cadet's intelligence, common sense, ingenuity and physical stamina.  The cadet command assesses each cadet's performance and progress in officer traits, qualities and professionalism while attending the course.

Cadets in their junior and senior year of college must complete the leadership development course.  Upon successful completion of the course, the ROTC program, and graduation from college, cadets are commissioned as second lieutenants in the U.S. Army, National Guard, or Reserve. The cadet is a student at the Marion Military Institute, Ala.  She is the daughter of Kenneth L. Turner of Evans Road, LaBelle, Fla., and Jackie L. Nesbitt of Lehigh, Fla.  Turner is a 2006 graduate of LaBelle High School.
 

The Difference?

Last week I turned 79.  In dog years that is 11.2, and people say that I'm doing a good job in supporting the national aging average.  Well, I guess that's one way of avoiding the fact that anyway you cut it, 79 is a long time to have to keep doing it until you get it right. On the other hand the alternative, although practiced by many, only once, doesn't provide for any margin of error, and, to date, I've still got more questions than answers.

For example, I remember a quote from Charles Seymour, a 20th century educator and historian who said, " We shall seek the truth and endure the consequences."  Applying that today in the hetererdoxic atmosphere of adversarial posturing at the highest level of government challenges even the staunchest beleivers in constitutional rights, the rule of law, and taking personal responsibility for one's actions, or inactions.

One of the advantages of aging is the experiences, good and bad, that, if you are fortunate enough to maintain your faculties, that those very experiences can define you as a person.  Somewhere in my checkered past, I remember someone telling me that, "Winners make things happen, while losers let things happen."  It would be too simplistic to think that this simple statement could be omnisicently responsible for anyone's successes or failures, but it's certain that the world loves a winner, and hates losers.

Now that the school bell has sounded and school is in session, an often wrought but disdainful chorus of concerns of how to elevate and save the education process from scholarly and financial disaster is emanating loud and clear from "Tellemallahassee."  With the latest educational shot across the bow, of putting the Lottery up for sale.  Now, what do you think the "odds" might be of this succeeding?
As strange as it might seem, I actually was involved in a situation that at the time seemed rather contentious, but I beleive today has meaningful relevancy to one of the basic issues facing the educational community.

I was at an informal dinner at our CEO's home, and after dinner, he, our host opened up a discussion wherein he was explaining, in his opinion, one of the problems with education.  His argument was that what is a child going to learn from someone who decides their best option in life is to become a teacher.  He referenced that old saying that "Those who can do, and those that can't, teach.'  There happened to be a teacher at the party who he asked, "Now Fred, you're a teacher.  Be honest.  What do you make?"

Fred's reputation for honesty and frankness was well known to the group, and after a meaningful pause, he replied.  "You want to know what I make?  Well, for one thing, I make the kids work harder than they ever thought they could.  I make a C+ feel like a Congessional medal of Honor.  I make the kids sit through 40 minutes of class time when their parents can't even make them sit for 5 minutes without an I Pod, game boy or a video playing.  You want to know what I make? 

I make kids wonder.  I make them question.  I make them criticize.  I make them apologize and mean it.  I make them have respect and take responsibility for their actions.  I teach them to write.  I make them read, read, and read some more.  I make them prove and disprove all their work in math.  I nmake my students from other countries and cultures learn everything the need to know in English without encroaching on their cultural identity and customs.  I make my classroom a place where all my students feel safe.  I make my students stand and say the Pledge of Allegiance to the Flag, as a further identification of living in the United States of America.  Finally, I help to make them understand that if they use the God's gifts that they were given, work hard, and follow their hearts, they will succeed in anything they choose to undertake in life."
He  continued, "You wanted to know what I make?  I learned some time ago that when people want to judge me by what I make, I can hold my head up high and pay them no attention, because what I make is a "DIFFERENCE!"  "What do you make?"
 
Oh wouldn't it be wonderful if Fred could have had this conversation with the "Wonderkungs" in "Tellemallahassee!"
As I was mentioning earlier, "experiences can define you as a person", and to this day I have the highest personal regard for our teachers, and "What they really make."

CREW Land Trust Free Hike

Saturday Morning Guided Walk/Hike - The CREW Land & Water Trust will host a hike on the 2nd Saturday of each month for all ages from 9:00 a.m. – noon. The hike is free, although donations to support the Trust’s preservation efforts are appreciated. Reservations (239-657-2253) are helpful but not required. Hikers are encouraged to bring a beverage and wear old shoes.

Trouble With Frequent Electric Outages?

How To Effectively Get FPL To Fix It
