Zelenogorsk Town Court obliged to exact Electrochemical Plant to compensation of moral damage of $4,400 to a child.
A Zelenogorsk woman brought a claim against Electrochemical Plant to receive compensation of moral damage caused to her under-aged son, the press service of the Krasnoyarsk Territory Judicial Department informed. She specified in her claim that her six-year-old son had been hit by another child in the kindergarten owned by Electrochemical Plant in October 2006. As a result of the blow, the woman's child suffered spleen rupture, and doctors had to ablate his spleen. The boy stayed in hospital for ten days. According to the reference of a forensic medical expert, the bodily harm caused to the child resulted in serious health damage.
It was established in court that the boy was injured due to improper fulfillment of functional duties by a kindergarten teacher. According to Russian laws, physical and material damage caused to a person shall be compensated by the person who inflicted the damage. If an under-aged citizen caused damage while being in an educational or medical establishment, this institution is responsible for damage unless it is proved that damage was not caused through his or her fault.
Violating her administrative functions, the kindergarten teacher failed to prevent the conflict between the children in time, the court established. Taking into account all the details of the case, the owner of the kindergarten – Electrochemical Plant – was fined to $4,400 as compensation of physical and moral damage caused to the child.
