It is marginally true. Both entities operate in a grey area between officially sanctioned troops and a totally private army. Both receive a wink and a nod from their respective governments as they enjoy more latitude in dealing with their various charges (than gov't troops), but are protected by the same governments left hand. You make a great point. Add to that the inclination or temptation of the sitting powers to use private "armies" for "unofficial " ops in foreign lands that might be considered to "dirty" for U.S. troops. The French Foreign Legion provides some great examples. (Friday Jun 6 | post #39)
