The Appeals Court issued a temporary stay while arguments are made at this appeals stage, it did not issue an opinion striking down the lower court's decision. The Bush regime would prefer to disregard the legal issues and treat these prisoners with impunity, but that's not how the Constitution works.

Every point you made - no due process for non-civilians, justifiable torture for people your country arbitrarily decide to call "enemy combatants"... they are not in line with the US's founding documents, or at least a dozen International and American treaties that your governments have signed in good faith (we thought). Ignore the Geneva conventions. Return to the idea that torture elicits accurate information. Withdraw into your shells and become 100% xenophobic and hateful of anyone not from "the motherland". "Never Again" These are the types of things that the world knew they had to get rid of because after seeing the horrific things that the Nazi's did. You're sliding, America. It's tragic - you're sliding so far back into barbarism. Such a shame. The nation had such great promise. Guess every great endeavor has to rot and fall away in the end.

In war there is always a possibility of prisoners captured on both sides. Interrogation is expected, but not torture, and no enemy prisoners of war should be relased in the United States. However, we should treat theirs as humanely as we would hope they would treat ours. As long as any soldiers are prisoners, they are no longer a danger and causing harm to them is a war crime. There may always be opportunities for prisoner exchanges, prisoners could sometimes be used as a bargaining chip to our advantage, important intelligence may be obtained over a long period of time, and prisoners should be released upon conditions of a treaty of peace. As evidenced in the past, we can not always expect humane treatment of our prisoners by the enemy terrorists, but I think there are good reasons for keeping all prisoners alive and well.
