RULES OF PROCEDURE FOR WRITTEN SUBMISSIONS FROM RESIDENTS OF CO-OPERATIVE HOUSING PROJECTS IN CONNECTION WITH CERTAIN MINISTERIAL CONSENT DECISIONS UNDER THE
HOUSING SERVICES ACT, 2011
THESE RULES APPLY WITH RESPECT TO A REQUEST FOR MINISTERIAL CONSENT UNDER SECTION 162(3) OF THE HOUSING SERVICES ACT, 2011 TO TRANSFER A CO-OPERATIVE HOUSING PROJECT UNDER RECEIVERSHIP TO A NON-PROFIT CORPORATION
- Following receipt of a request from a Service Manager for a Ministerial Consent under the Housing Services Act, 2011 to transfer a co-operative housing project under receivership to a non-profit corporation, the Director of the Housing Funding and Risk Management Branch will provide the receiver/manager with a package of notice letters to be delivered to all residents of the co-operative housing project.
- The notice letters may be delivered by hand or sent by mail.
- The notice letters will be provided to the receiver/manager for purposes of posting a copy of the notice letter in a conspicuous place in the housing project.
- The notice letter will indicate that the Ministry is considering the request for Ministerial Consent to transfer ownership of the co-operative housing project to a non-profit corporation and that as part of the consent decision making process, the Ministry is providing each resident with an opportunity to make a written submission on the matter, before any decision is made by the Ministry.
- The notice letter will indicate the telephone number and email address of Ministry staff who can be contacted in order to obtain a copy of materials provided to the Ministry in connection with the consent request and information on considerations relevant to the Ministry in the matter.
- The notice letter will indicate that submissions must be made in writing.
- The notice letter will indicate the address and email address of Ministry staff to whom the submission will be sent.
- The deadline for submissions will be at least one (1) month following the date on which the Director of the Housing Funding and Risk Management Branch provides the receiver/manager with the package of notice letters to be delivered to all residents of the co-operative housing project.
- The submissions will be reviewed and taken into consideration by Ministry staff with responsibility for making the Ministerial Consent decision.
