Question:
Several people have answered my queries about the patent bar exam. I really appreciate it. I'm going to have more questions over time, I'm sure, but for now just one: Is the patent bar exam like the regular bar exam, in that you can take it multiple times if you fail the first time? Or do you just get one shot, or a limited number of tries, before flunking is permanent?

While I'm here, I hope no one objects to a promo: I'm a technical writer, with a strong background in physics and math, and a pretty good basic grasp of telecomm and electronics principles. Answer:
You can take it multiple times and I don't believe there is a limit.

The PTO is going to a computer based exam administered by a non-government contractor. The exam will eventually be offered far more frequently than the past twice per year, but there are not enough details available to say how the frequency will ramp up. I have heard that the PTO will put up an application form in the next two weeks.

There may be some limits to how quickly you can take a new exam after failing one, but I imagine you'll be able to take the exam far more frequently than twice a year if necessary.

I'm moving to the DC area myself this month.

  • I don't know the reciprocity rules for Ohio, but the the rules for New York when I was admitted were that you had to apply to DC within five years of your having achieved sufficiently high scores on the MPRE and MBE, as well as having been admitted to the bar here....and pay the DC fee. Rules may have changed since...call the DC bar association if you can't find anywhere else so can anyone in the group help me please?
